We will carefully review the Sale of Contract and conduct  property searches, prepare the Transfer Form and other required legal documents, organise for existing mortgages and caveats be withdrawn from the Certificate of Title, calculate an Adjustment Statement of council, water and ESL rates up to settlement, calculate amounts due to the Vendor at settlement, distribute payments relating to the property held in trust, organise a special water meter reading and calculate final water use owing up to settlement and attend to settlement using electronic conveyancing in most instances.

Caveats

 

A Caveat can be lodged against a Certificate of Title to protect a person's interest in property. 

 

Instances where a Caveat may be lodged against a property include:

  • Detesting a Will- a Caveat will prevent a property  being sold until a Court Order is made regarding whether a person's interests in a Will were sufficient.

  • Personal loans or unregistered mortgages- a Caveat will ensure the Caveator is paid any money owing to  them when the property is sold. 

Drafting Contract of Sale and Vendor's Statement

Family Transactions
and Transmissions


We will prepare and lodge all documents to finalise family property transactions such as:
  • Gifting property to family

  • Transfer of property in accordance with a Family Law Agreement or Court Order

  • Transmission of property to beneficiaries in accordance with a Will

  • Change of name due to marriage or divorce. 

Land Division

 

Our land division service includes preparing council documents for approval to subdivide land, liaison with surveyors, preparing and submitting required documents and forms with the SA Land Titles Office for new Certificates of Titles and any Easements, preparation of financial statements and payment of fees and taxes associated with the land division transactions.  
 
 

Verification of Identity and Authority Checks

 

Verification of Identity and Authority checks are required to be undertaken by conveyancers to minimize the risk of fraud when transacting real property.

 

Clients involved in a property transaction are required to submit identification from one of the following categories:

 

Category 1:  

A Passport plus either an Australian driver’s licence or Proof of Age Card (photo)

Category 2:  

A Passport plus

·     a full birth certificate, citizenship         certificate or descent certificate, and

·     a Medicare, Centrelink or Department of Veterans’ Affairs card.

Category 3:  

An Australian driver’s licence or form of photographic Proof of Age Card plus

·     a full birth certificate, citizenship certificate or descent certificate, and

·     a Medicare, Centrelink or Department of Veterans’ Affairs card.

Verification of Authority checks include the following documents which must be produced during our office meeting:

 

Contract of Sale (Vendor and Purchaser Authority documents)

Letter from Mortgagee approving finance (Purchaser Authority document)

Council Rates, Water Rates, ESL Rates (Vendor Authority documents).
